These Terms of Service (“Terms”) govern your access to and use of the Safety Real Time website, applications, and services (the “Services”). By accessing or using the Services, you agree to these Terms. If you use the Services on behalf of an organization, you represent that you are authorized to bind that organization.
Use of the Services
You agree to use the Services in compliance with applicable laws and regulations and not to misuse, interfere with, or attempt to disrupt the Services or access them without authorization.
Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly of any unauthorized use.
Acceptable use
- Do not upload unlawful, infringing, or harmful content.
- Do not attempt to reverse engineer, resell, or misuse the Services.
- Do not use the Services in a way that violates the rights of others or applicable transportation, safety, or privacy laws.
Service builds & fees
The scope, deliverables, fees, and any usage limits (including included voice-agent minutes and overage rates) for the automations, voice agents, dashboards, and software we provide are set out in the order or customer agreement between you and Safety Real Time. Fees are due as described there.
Third-party services & integrations
The Services may connect to third-party systems you choose (such as ELD, telematics, or accounting providers). Your use of those systems is governed by their own terms, and we are not responsible for third-party products or services.
Intellectual property
The software, content, and branding provided through the Services are owned by Safety Real Time or its licensors and may not be copied, modified, or reused except as permitted by these Terms or your agreement with us. You retain ownership of your own data.
Disclaimers
The Services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. You remain responsible for your own regulatory and DOT/DVIR compliance obligations.
Limitation of liability
To the fullest extent permitted by law, Safety Real Time will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, arising out of or relating to your use of the Services. Our total liability is limited as set out in your customer agreement.
Governing law
These Terms are governed by applicable law. The specific governing law and venue for any dispute are set out in your customer agreement with Safety Real Time.
Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date above, and your continued use of the Services constitutes acceptance of the updated Terms.
